The court documents clearly show that although the social activist was banned from leaving the country, he was not released from the border, and his detention was formalized nine hours later.
"When Nijad saw that he was angry, he took a knife from the policeman's pencil case, cut his own throat from two sides, and 16 stitches were put in his throat."
Parvin Ibrahim, the wife of social activist Nijad Ibrahim, who was arrested in Baku in early September, says this. Parvin Ibrahim, who is currently living in Moldova, says his wife was arrested because she criticized the Azerbaijani police.
According to him, the incident that resulted in Nijad's capture took place on September 9 in the Nasimi district. However, even before that, they assumed a "slandering" operation would be established.
"We wanted to leave the country in 2022, and they said that the Ministry of Internal Affairs (MIA) has restricted Nijad Ibrahim's exit. We also appealed to the court in this regard. The court ruled that the ban on exiting the country should be lifted. At the same time, we are requesting the Ombudsman Office. We received a certificate from the Ministry of Internal Affairs stating that there is no ban on our exit from the country.
We showed the documents, they said that if you want these documents, throw them in the trash, it seems that your access is restricted in our system. Later, Nijad contacted the 102 Ministry of Internal Affairs service, and one day later, it was recommended to apply to the Presidential Administration. Nijad also signed up for admission. They said you will be helped on the 19th of the month, don't worry. After that, there were calls from the 19th police station in Nija asking who would be in and what your complaint would be. They demanded that he come and explain to the department. Nijad didn't say anything and didn't leave; he thought that they would abuse him and catch him," the social activist's wife says.
Parvin Ibrahim says he left the country while his wife stayed in Baku. After that, everything happened as expected, and Nijad Ibrahim was arrested.
"Just before that, he was preparing to get a category "C" driver's license. On September 9, the head of the driving school called Nijad, saying that the documents were ready to come and pick them up near our house. The address, he said, was near one of the gas stations in Nasimi district. When Nijad got there, we contacted him. His mother came out and saw many policemen near our house and was suspicious.
After that, we went to the Ministry of Internal Affairs and various police stations, they all said that it is not here, we did not stop it. On the 11th of the month, the investigator of the Investigation Department of the Nasimi District Police Department, Colonel-Lieutenant Murad Guliyev called lawyer Zibeyda Sadighova that Nijad was arrested and will be brought to court. It became known in the court that Nijad was charged under Article 126.1 of the Criminal Code (deliberately causing serious harm to health)," said the wife of the public activist.
It is clear from the court documents that Nijad Ibrahim Nasimi is accused of injuring a person named Bahman Aliyev with a knife in the territory of the district. There is no clear information about the person presented as the "victim" and how the incident was committed in the decision regarding the selection of preventive detention measure.
Official documents reviewed by Abzas Media clearly show that Aliyev Bahman Bahram Oghlu is considered the "victim" in the case. Bahman Sabunchu, 41, is registered in the district's "Second area." It is not reported what issue he had an argument with Nijad Ibrahim in Nasimi district in the morning.
Nijad Ibrahim denied the accusations in his court speech and said that while he was waiting for the driving school teacher, a person approached him, punched him several times in the face, and ran away. Later, a large number of policemen came out and took Nijad to the ground in handcuffs.
"They severely tortured me at the police station; I wrote that, yes, I hit them. But I said, even if you kill me, I will not write and I will not sign," Nijad Ibrahim said.
Parvin Ibrahim, the social activist's wife, says that after the incident, her relatives went and asked the people working in the area what happened. It turned out that the police took several people to the unit and put pressure on them:
"Witnesses told Nijad's relatives that a person fell and screamed on the ground, and the police took a picture of him, then they stood up and left. They said they took us to the unit and pressured us to testify that Nijad stabbed that person. The witnesses said this."
In the decision regarding the selection of preventive measures for arrest, it is stated that the incident took place at 11 am on September 9, and Nijad Ibrahim was arrested at the scene. However, in the section regarding the selection of a 4-month pretrial detention measure, it is stated that the period of detention should be calculated from the moment of the person's arrest, September 9 at 8:30 p.m. According to the legislation, the restriction of freedom is considered "detention."
Although Nijad Ibrahim was caught in the alleged "crime," the police did not explain in court why they waited for almost 10 hours to document it.
Nasimi district court judge Anar Ibadzade, with the participation of Nasimi district prosecutor's assistant Mrs. Ashrafova, considered the questionable presentation of Nasimi district prosecutor and chief justice advisor Hasan Hanifayev reasonable and ordered Nijad Ibrahim to be detained for four months.
"Abzas Media" addressed questions about the issue to the Ministry of Internal Affairs but could not get an answer.
Nijad Ibrahim has been arrested many times before on various charges. The last time he was accused of violating the quarantine rules was in 2021, and he was sentenced to one year and three months in prison. Local human rights activists recognized him as a political prisoner.
